What Is a Legal Guardian in Michigan?

27 Mar 2026

A legal guardian is a person appointed by a Michigan probate court to make personal, medical, and sometimes financial decisions for another individual who is unable to do so independently. The individual subject to guardianship is known as the “ward.” Guardianship is governed by Michigan’s Estates and Protected Individuals Code (EPIC) and is intended to protect vulnerable individuals while preserving as much independence as possible.

Guardianship is most commonly used for minors, incapacitated adults, or individuals who lack the ability to make informed decisions due to illness, injury, or disability.

Because guardianship significantly limits an individual’s legal rights, Michigan courts require clear and convincing evidence that it is necessary.

Capacity and Incapacity

\Legal capacity refers to a person’s ability to understand and make informed decisions. When an individual cannot adequately care for themselves or communicate decisions regarding their health or safety, the court may determine that the person is legally incapacitated. Importantly, guardianship may be avoided if proper estate planning tools—such as a Durable Power of Attorney or Healthcare Directive—are already in place and functioning properly.

Types of Guardianship in Michigan

Michigan law allows for different forms of guardianship depending on the ward’s needs. Guardianship may be limited or full, temporary or permanent. Courts are required to tailor the guardian’s authority to the least restrictive level necessary to protect the individual.

Role and Responsibilities of a Guardian

A guardian’s duties may include making medical decisions, arranging living accommodations, consenting to treatment, and ensuring the ward’s overall well-being. Guardians must act in the ward’s best interests at all times and are subject to ongoing court supervision, including annual reporting requirements.

Guardianship vs. Estate Planning

Guardianship is often a last resort. Proper estate planning under Michigan EPIC—including Trusts, Powers of Attorney, and Healthcare Directives—can frequently eliminate the need for court intervention and preserve family privacy.
